Terms of Service

1. AGREEMENT TO TERMS

These Terms constitute a legally binding agreement between you and Sona Pets LLC, an Illinois limited liability company (doing business as Sona), concerning your use of our website, mobile application, physical smart tags, finder pages, and related services (collectively, the "Services"). In these Terms, "Sona," "we," "us," and "our" refer to Sona Pets LLC unless the context requires otherwise. By purchasing a tag, creating an account, or using the Services, you agree to these Terms.

Sona is a consumer brand; contractual obligations run to Sona Pets LLC. Support, fulfillment, and continued operation of the Services depend on this business remaining active. We do not guarantee perpetual availability of the Services, and discontinuation of operations could affect your ability to manage tags or access owner features, subject to applicable law.

2. ELIGIBILITY & AGE REQUIREMENTS

Sona owner accounts, pet passport management, and tag registration are intended only for individuals who are at least 18 years of age. By creating an account, claiming a tag, or registering a pet passport, you represent and warrant that you meet this requirement.

The Services involve binding agreements about pet care, owner contact information, optional location data for lost-pet recovery, payment processing through Stripe on our website, and other personally identifiable information. They are not directed to children or teenagers.

Where required by law (including Texas SB 2420 and similar app-store age laws), downloads of the Sona mobile app by users under 18 may require verification and parental approval through Google Play, the Apple App Store, or another authorized app marketplace. Even with marketplace approval, you may not create a Sona owner account unless you are 18 or older.

Finder pages remain open to everyone. A person who finds a lost pet may tap the NFC tag and view the public finder page in a mobile browser without creating a Sona account, regardless of age.

3. ACCOUNT SECURITY (MOBILE APP)

The Sona mobile app may offer optional biometric sign-in (Face ID, Touch ID, or fingerprint) to help you sign back in after you sign out or after automatic sign-out for inactivity. This is a convenience feature only — it is not required to create an account or use the Services.

  • Biometric verification is performed by your device's operating system. Sona Pets LLC does not receive or store biometric identifiers, templates, or scans.
  • When enabled, an encrypted session token may be stored on your device so you can resume sign-in without re-entering your password. You control this in Account → Security and may turn it off at any time.
  • Biometric sign-in does not replace two-factor authentication where required, and you remain responsible for securing your device and account credentials.

4. MOBILE APP AVAILABILITY

Tag activation and pet profile management currently require a compatible Android device and the Sona Android app on Google Play. An iOS owner application is under development and is not offered for download at this time. We do not guarantee that an iOS app will be released, or on what timeline. Optional interest feedback you submit on our website (for example, voting whether you would use an iOS owner app) is non-binding, creates no obligation on either party, and does not entitle you to early access, refunds, or compensation. You are solely responsible for confirming that you have a compatible device before purchase. This limitation applies to pet owners only. Third parties who find a lost pet may tap the NFC tag using any modern smartphone and view the public finder page in a mobile browser without installing the Sona app.

At checkout on our website, you must affirmatively acknowledge the Android activation requirement before payment. That acknowledgment supports the refund limitations in Section 9 and confirms you did not rely on an unavailable iOS owner app at the time of purchase.

5. PRODUCT LIMITATIONS & DISCLAIMER

Sona is a passive identification and communication tool—not a GPS tracker, medical device, or emergency response service. Tags do not contain batteries or active GPS. Location features rely entirely on a finder tapping the NFC tag and their device granting explicit permission to share location data. We do not guarantee your pet will be found, that a finder will tap the tag, or that location or alert data will be transmitted or received. Recovery depends on voluntary action by finders—if a finder does not tap or contact you, or if their device or browser blocks NFC, location, or notifications, Sona is not responsible for that outcome. Physical tags are subject to wear, environmental damage, and manufacturing variance; you are responsible for verifying that the NFC chip remains readable. Pet names and private contact details are managed in the app—not engraved on hardware at checkout. Material options selected at checkout describe fulfillment instructions only and may differ slightly from marketing renders. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Product Safety and Ingestion Warning. Sona tags and related hardware are identification devices, not chew toys. You are solely responsible for securely attaching each tag to your pet's collar or harness, checking fit and condition regularly, and supervising your pet so the tag is not chewed, broken, or swallowed. Sona Pets LLC disclaims all liability for veterinary bills, injury, choking, obstruction, or any other harm arising if a pet chews, bites, swallows, or otherwise ingests the tag, its components, attachment hardware (including split rings or cords), or fragments thereof.

7. ACCEPTABLE USE & USER CONTENT

You agree not to use the Services for any illegal purpose, to harass finders, or to upload offensive, illicit, or copyrighted material to your pet's digital passport. You grant Sona Pets LLC a license to host and display the pet photos and text you upload solely for the purpose of operating the Service. We reserve the right to suspend or terminate accounts that violate these terms or abuse notifications, messaging, or network features.

8. INTELLECTUAL PROPERTY

All software, designs, trademarks, and code associated with Sona are owned by Sona Pets LLC or its licensors. You may not copy, reverse-engineer, or distribute our digital or physical assets.

9. PURCHASES AND REFUNDS

Physical tags are blank factory hardware (NFC) shipped for activation in the app. Material/finish selections at checkout are fulfillment instructions, not personalized engraving of your pet's name or phone number. By completing checkout you acknowledge the Android app requirement stated at purchase (including the required checkout confirmation). Because tags are made-to-order hardware, all sales are final except where required by law or as described below for defective or nonconforming hardware.

"Materially different" means functional or fulfillment error, not minor cosmetic variance. Examples that may qualify for remedy or refund where required by law include: (a) the NFC chip on the tag cannot be read by a typical smartphone after normal installation on a collar; (b) wrong material or finish class was shipped (for example, silicone ordered but metal received); (c) tag is cracked, delaminated, or missing a working NFC component. Examples that generally do not qualify: slight shade or gloss differences from marketing renders, normal manufacturing tolerance, or dissatisfaction with Android-only owner app availability when you acknowledged that limitation at checkout.

Shipping times are estimates only. Stripe processes payments; charge disputes must be raised with your payment provider in accordance with their rules. Contact support@sonatags.com for order issues before initiating a chargeback when possible.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SONA PETS LLC, ITS MANAGERS, MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROPERTY, EMOTIONAL DISTRESS, INJURY, OR LOSS OF A PET, VETERINARY EXPENSES, OR INJURIES RESULTING FROM PRODUCT INGESTION OR HARDWARE FAILURE, OR FOR ANY DAMAGES ARISING FROM (A) UNAVAILABILITY OF THE IOS APP OR ANY PLATFORM, (B) FAILURE OF A FINDER TO TAP A TAG, (C) INACCURATE OR WITHHELD LOCATION DATA, (D) DELAYED OR FAILED NOTIFICATIONS, (E) RELIANCE ON ROADMAP, BETA, OR MARKETING STATEMENTS, (F) A PET CHEWING, SWALLOWING, OR INGESTING THE TAG OR ATTACHMENT HARDWARE, OR (G) PHYSICAL TAG OR HARDWARE FAILURE, WEAR, OR DETACHMENT. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID Sona Pets LLC FOR THE TAG GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE EVENT, OR (II) FIFTY U.S. DOLLARS ($50).

11. DISPUTE RESOLUTION: ARBITRATION & CLASS ACTION WAIVER

Except for disputes that qualify for small claims court as stated below, any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding arbitration on an individual basis, not as a plaintiff or class member in any purported class, collective, or representative proceeding. You and Sona Pets LLC each waive the right to a jury trial and to participate in a class action for claims covered by this agreement.

Small claims exception. Either party may bring an individual claim in small claims court in DuPage County, Illinois (or your local small claims court if it has jurisdiction and you prefer to file there), so long as the claim remains within that court's monetary and subject-matter limits and is brought only on an individual basis.

12. GOVERNING LAW & MODIFICATIONS

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles, except where federal law applies. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Illinois. We reserve the right to modify these Terms at any time. If we make material changes, we will notify you via email or a prominent in-app notice prior to the changes taking effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Sona Pets LLC, its managers, members, officers, employees, contractors, and affiliatesfrom and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your misuse of the Services, care links you create or distribute (including personal information you chose to include), or your violation of any rights of a third party, including finders and caregivers. This obligation survives termination of your account or cessation of your use of the Services to the extent permitted by law.
